End User License Agreement

This End User License Agreement (the "EULA") is between you and Forrest Holdings LLC ("FORREST," "we," or "us"). It governs your license to download, install, and use the FORREST mobile application (the "App"). The App gives you access to the FORREST service, which is governed by our Terms of Service (the "Terms") and our Privacy Policy. This EULA forms part of the Terms. Words defined in the Terms have the same meaning here.

You accept this EULA when you tap the button in the App that says you agree. If you do not agree, do not install or use the App.

1. License

1.1 Subject to this EULA and the Terms, FORREST grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use one copy of the App on each Apple or Android device that you own or control, for your own personal, non-commercial use, and as permitted by the usage rules of the app store you downloaded it from (the "Store").

1.2 The App is licensed, not sold. FORREST and its licensors keep all rights, title, and interest in the App, including all intellectual property rights. All rights not expressly granted to you are reserved.

2. Restrictions

You will not, and will not help anyone else to:

copy, modify, translate, or create derivative works of the App, except as the law expressly allows despite this restriction;

decompile, disassemble, reverse engineer, or try to derive the source code of the App, except as the law expressly allows despite this restriction;

rent, lease, lend, sell, sublicense, distribute, or make the App available over a network where it could be used by multiple devices at once;

remove or change any notice of ownership in the App;

get around any security, age, verification, or purchase control in the App;

use bots, scrapers, or automated means to access the App or collect data from it;

use the App in breach of the Terms, our Community Guidelines, our Acceptable Use Policy, or the law.

3. Updates

We may release updates that fix bugs, add or remove features, or meet legal requirements. Updates may install automatically depending on your device settings. We may require you to install an update to keep using the App. This EULA applies to every update unless the update comes with its own terms.

4. Permissions and data

The App asks for access to your camera, microphone, photos, and location while you use the App. Each permission is requested only when you use a feature that needs it, and you can change permissions in your device settings. How we collect, use, and protect your information is described in the Privacy Policy.

5. Termination

This license lasts until you or we end it. It ends automatically if you break this EULA. It also ends when your account is closed under the Terms. When it ends, you must stop using the App and delete it from your devices.

6. Disclaimer and limitation of liability

The disclaimers in Section 11 and the limitations in Section 12 of the Terms apply to the App.

7. Export and sanctions

You represent that (a) you are not located in a country that is subject to a U.S. Government embargo or that the U.S. Government has designated as a "terrorist supporting" country, and (b) you are not on any U.S. Government list of prohibited or restricted parties. You will comply with all applicable export and sanctions laws.

8. Open-source software

The App includes open-source software components that are licensed under their own terms. Those terms are available in the App under Settings, About, Open-Source Licenses, or on request at legal@forrestthesocialapp.com. Where an open-source license gives you rights that this EULA would otherwise restrict, the open-source license controls for that component only.

9. Apple App Store terms

If you downloaded the App from Apple's App Store, the following also applies, and it controls if it conflicts with the rest of this EULA:

Acknowledgement. This EULA is between you and FORREST only, not with Apple Inc. ("Apple"). FORREST, not Apple, is solely responsible for the App and its content.

Scope of license. The license in Section 1 is limited to a non-transferable license to use the App on any Apple-branded products that you own or control and as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the App may be accessed and used by other accounts associated with you through Family Sharing or volume purchasing where the Usage Rules allow it.

Maintenance and support. FORREST is solely responsible for providing any maintenance and support services for the App, as set out in this EULA or as required by law. Apple has no obligation to furnish any maintenance or support services for the App.

Warranty. FORREST is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, for the App to you. To the maximum extent the law allows, Apple has no other warranty obligation with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty are FORREST's responsibility.

Product claims. FORREST, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and use of it, including (a) product liability claims, (b) any claim that the App fails to conform to any applicable legal or regulatory requirement, and (c) claims arising under consumer protection, privacy, or similar legislation.

Intellectual property rights. If a third party claims that the App or your possession and use of the App infringes that third party's intellectual property rights, FORREST, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of that claim.

Legal compliance. You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

Developer contact. Questions, complaints, or claims about the App should be sent to Forrest Holdings LLC, 79 El Dorado Drive, Little Rock, AR 72212, support@forrestthesocialapp.com.

Third-party terms. You must comply with applicable third-party terms of agreement when using the App, such as your wireless data service agreement.

Third-party beneficiary. Apple and Apple's subsidiaries are third-party beneficiaries of this EULA, and upon your acceptance of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary.

10. Google Play terms

If you downloaded the App from Google Play, you acknowledge that this EULA is between you and FORREST only, not with Google LLC ("Google"). Your use of the App must also comply with the Google Play Terms of Service. Google is not responsible for the App or its content and has no obligation to provide maintenance or support for it.

11. Governing law and disputes

Sections 16 through 18 of the Terms (informal resolution, arbitration and class action waiver, and governing law) apply to any dispute about this EULA.
